Welcome to Hearth & Hue (“Hearth & Hue,” “we,” “us,” or “our”). By accessing this website, registering for classes, or allowing your child to participate in any Hearth & Hue program, you agree to these Terms & Conditions.
IF YOU DO NOT AGREE, DO NOT USE THIS WEBSITE OR ENROLL YOUR CHILD.
1. PROGRAM DESCRIPTION & DROP-OFF REQUIREMENTS
Hearth & Hue provides drop-off children’s art classes in Old Town Lorena, Texas.
By enrolling your child, you acknowledge and agree that:
You are not required to remain on-site during class;
You agree to remain in close proximity to Old Town Lorena and be reachable at all times during class;
You agree to return immediately if contacted due to an emergency or behavioral issue.
Failure to remain reachable may result in immediate removal from the program without refund.
2. ASSUMPTION OF RISK (TEXAS-COMPLIANT)
You understand and acknowledge that participation in art classes involves inherent and foreseeable risks, including but not limited to:
Cuts or injuries from tools or materials;
Allergic reactions to paints, glues, clays, or other art supplies;
Slips, falls, spills, or other accidental injuries.
YOU KNOWINGLY AND VOLUNTARILY ASSUME ALL RISKS, whether known or unknown, foreseeable or unforeseeable, associated with your child’s participation.
3. WAIVER, RELEASE, AND EXPRESS NEGLIGENCE CLAUSE
AS A CONDITION OF PARTICIPATION, A SIGNED WAIVER AND RELEASE OF LIABILITY IS REQUIRED.
By using this website or enrolling your child, you acknowledge and agree that:
YOU VOLUNTARILY RELEASE, WAIVE, DISCHARGE, AND HOLD HARMLESS HEARTH & HUE, ITS OWNERS, EMPLOYEES, INSTRUCTORS, VOLUNTEERS, AGENTS, AND AFFILIATES FROM ANY AND ALL CLAIMS, DEMANDS, OR CAUSES OF ACTION ARISING OUT OF OR RELATED TO YOUR CHILD’S PARTICIPATION, INCLUDING CLAIMS ARISING FROM THE ORDINARY NEGLIGENCE OF HEARTH & HUE OR ITS REPRESENTATIVES, TO THE FULLEST EXTENT PERMITTED BY TEXAS LAW.
This release is intended to be as broad and inclusive as allowed under Texas law and is governed by the Express Negligence Doctrine.
No child may participate without a properly executed waiver.
4. MEDICAL AUTHORIZATION & HEALTH DISCLOSURE
You represent and warrant that:
Your child is in good physical and mental health and capable of participating safely;
You have disclosed all known medical conditions, allergies, or special needs.
You authorize Hearth & Hue staff to:
Administer basic first aid; and
Seek emergency medical treatment if necessary.
You accept full financial responsibility for any medical expenses incurred.
Failure to disclose relevant information may result in removal from the program without refund.
5. PICKUP POLICY & LATE FEES
Classes end promptly at their scheduled time.
Late pickups exceeding 5 minutes may result in a late fee;
Repeated late pickups may result in removal from the program without refund.
6. BEHAVIORAL STANDARDS & RIGHT TO REFUSE SERVICE
Hearth & Hue reserves the right, in its sole discretion, to refuse or discontinue service for reasons including but not limited to:
Unsafe, disruptive, or aggressive behavior;
Failure to follow safety rules or procedures;
Harassment, disrespect, or inappropriate conduct;
Any action that threatens the safety or well-being of participants or staff.
Removal under this section does not entitle you to a refund.
7. PHOTO & VIDEO USE
Photos or videos may be taken during classes.
Images of children will be used for promotional purposes ONLY if written parental consent has been provided.
Consent may be revoked at any time in writing.
8. LIMITATION OF LIABILITY
To the maximum extent permitted by Texas law, Hearth & Hue shall not be liable for any indirect, incidental, or consequential damages arising from participation in programs or use of this website.
9. GOVERNING LAW & VENUE
These Terms & Conditions shall be governed by the laws of the State of Texas.
Exclusive venue for any dispute shall be McLennan County, Texas.

Hearth & Hue is committed to protecting the privacy of families and children participating in our programs.
1. INFORMATION WE COLLECT
We may collect the following information (from forms and bookings):
Parent/guardian name and contact information;
Child’s name, age, and class enrollment details;
Emergency contact information;
Medical or allergy information voluntarily disclosed;
Photo/video consent selections;
Analytics & Cookies (Squarespace analytics & cookies).
Payments are completed via third-party services such as Venmo. Hearth & Hue does not store payment information.
2. USE OF INFORMATION
Information is used solely to:
Administer classes and registrations;
Communicate with parents or guardians;
Respond to emergencies or behavioral issues;
Comply with legal or insurance requirements.
We do not sell or rent personal information.
3. CHILDREN’S PRIVACY (COPPA-ALIGNED)
Children’s personal information is submitted by a parent or legal guardian and only to the extent reasonably necessary for participation and safety.
Information is not shared except:
In medical emergencies;
With service providers performing necessary functions;
As required by law.
4. PHOTO & VIDEO PRIVACY
Photographs or recordings of children are:
Taken during program activities;
Used only if explicit consent has been granted;
Never sold or distributed to third parties.
5. DATA SECURITY
Reasonable administrative and technical safeguards are used to protect personal information. No online system can be guaranteed 100% secure.
6. YOUR RIGHTS
You may request to:
Access or correct personal information;
Withdraw consent for photos or marketing;
Request deletion of records, subject to legal retention requirements.
7. POLICY CHANGES
This policy may be updated at any time. Changes will be posted with an updated revision date.
